Welcome to Creatin. These Terms of Service ("Terms") govern your access to and use of the Creatin app, website (creatin.app), and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

Creatin is a platform that connects content creators with brands for ambassador-style UGC campaigns. Creators discover paid collaboration opportunities and manage deliverables. Brands create campaigns, review applications, and manage collaborations end-to-end.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• You will not use the Service for any illegal or unauthorized purpose

3. Account Registration and OAuth Authentication

a. Account Creation

To use certain features of the Service, you must create an account. You may register using your email address or through third-party authentication services including Google, Apple, Instagram, YouTube, and TikTok (collectively, "OAuth Providers").

b. OAuth Provider Requirements

When using OAuth authentication, you agree to:

• Comply with the terms of service and privacy policies of each OAuth Provider
• Maintain the security of your OAuth Provider accounts
• Grant Creatin permission to access your public profile information from OAuth Providers
• Understand that we only access information you explicitly authorize

c. Instagram OAuth

When you connect your Instagram account, you authorize Creatin to access your Instagram public profile information, media content, and analytics data for account verification, portfolio display, and analytics purposes. You can revoke this access at any time through your Instagram settings or within the Creatin app.

d. YouTube OAuth

When you connect your YouTube account, you authorize Creatin to access your channel information for verification and profile purposes. You can disconnect your YouTube account at any time.

e. TikTok OAuth

When you connect your TikTok account, you authorize Creatin to access your TikTok profile information, video content, and analytics data for account verification, portfolio creation, and analytics purposes. You can revoke access through TikTok settings or within the app.

f. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use or breach of security.

4. Service Description

a. For Creators

• Discovering campaigns that match your niche and content style
• Applying to campaigns with proposed rates and deliverables
• Messaging with brands to discuss collaborations
• Building a portfolio that showcases your work from connected social accounts
• Tracking earnings and managing payouts through your dashboard
• Accessing analytics and insights from your connected social media accounts

b. For Brands

• Creating campaigns with detailed descriptions, scripts, and deliverable requirements
• Searching for and discovering creators
• Reviewing creator applications and profiles
• Managing collaborations end-to-end
• Processing payouts through the integrated payment system
• Analyzing campaign performance

c. Platform Role

Creatin facilitates the connection between creators and brands but is not a party to any collaboration agreement. Brands are responsible for the accuracy of campaign information and processing payments for completed collaborations.

d. Getting Paid

Receive payments for completed collaborations through our secure payment system powered by Stripe Connect. Payment is processed to your connected bank account based on the agreed payout schedule.

5. User Conduct and Responsibilities

You agree not to:

• Use the Service for any unlawful purpose
• Impersonate any person or entity
• Misrepresent your follower counts, engagement metrics, or analytics data
• Submit false or misleading campaign or application information
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to any portion of the Service
• Upload content that violates intellectual property rights or contains illegal material
• Harass, abuse, or harm other users
• Violate any OAuth Provider's terms of service
• Use automated systems (bots, scrapers) to access the Service without permission

6. Content and Intellectual Property

You retain ownership of any content you create, upload, or connect to the Service. By using the Service, you grant Creatin a limited, non-exclusive, worldwide, royalty-free license to display and distribute your content solely for the purpose of operating the Service.

Content fetched from your connected social media accounts remains your property and is subject to the terms of service of those platforms. Creatin only displays this content with your explicit authorization.

The Service itself, including its design, features, logos, and trademarks, is owned by Creatin and protected by intellectual property laws.

7. Third-Party Services

• Social Media Platforms (Instagram, TikTok, YouTube): For OAuth authentication, profile verification, and analytics data. Your use is subject to their respective terms and privacy policies.
• Payment Processing (Stripe): For payout processing and payment management. Subject to Stripe's terms of service.
• Backend Infrastructure (Convex): For backend services, database hosting, and real-time data synchronization.
• Error Monitoring (Sentry): For application performance monitoring.
• Analytics (PostHog): For platform analytics.

8. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. CREATIN DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Creatin facilitates connections between creators and brands but does not guarantee that creators will receive campaign opportunities or that brands will find suitable creators. We are not a party to any collaboration agreements.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

9. Termination

You may terminate your account at any time using the "Delete Account" option in settings or by contacting [email protected]. We reserve the right to suspend or terminate your account at any time for violation of these Terms or fraudulent activity.

10. Governing Law

These Terms shall be governed by the laws of British Columbia, Canada. Any disputes shall be resolved in the courts of British Columbia, Canada.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on creatin.app/terms or through in-app notification. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
